Dear Friends of Buehler Park:
On November 4, our attorney, Bruce Morrison of Great Rivers Environmental Law Center filed our first brief with the Missouri Southern District Court of Appeals. The brief is posted on our website (follow link at top of homepage from http://buehlerpark.org).
In reading this brief keep in mind that the only issue before the Court of Appeals at this time is one of standing and that Circuit Court Judge Tracy Storie, in dismissing our suit, did so solely on the matter of standing, and gave no indication in his judgment as to why he ruled that we lacked standing.
Following the filing of our brief, The City of Rolla has 30 days to file its brief after which we can file a rebuttal. Following our second brief, oral arguments will be heard in Springfield before a panel of three appelate judges.
Our October 1 BBQ and "fun" raiser in Buehler Park was a great success.
The weather couldn't have been better. There was plenty of delicious
food for the over 100 people who attended. Everyone had a great time
and no one went away hungry.
Music was provided by the dulcimer and guitar group, Sometimes Tuesdays, consisting of Mike Pace, Jim Joiner, Karen Malen, Susan Wrassman, and Carol Spurlock.
Katy Henry, president of Great Rivers Environmental Law Center, drove all the way from St. Louis to be with us at our BBQ and meet with Buehler Park activists.
Special thanks to our director of activism, Elaine Grover, and to everyone else who worked or contributed to make our BBQ a success.
Photos of the event are posted on our website at http://buehlerpark.org/bbq_photos.html.
The activism committee is already planning another event for the Spring.
Checks for our legal counsel at Great Rivers keep coming in. During the
month of October, we raised $2,150. It is, of course, never too late to
contribute.
Checks can be sent to
